We are currently recruiting for an attorney with advertising law experience for a remote opportunity for a wellness and nutrition company. This is a remote opportunity, our client is offering 10+ hours per week, flexible schedule.
Position Overview
The Advertising Law Attorney will provide legal review and guidance on all consumer-facing content across our clients product lines. This includes marketing claims, packaging, website content, social media, paid ads, influencer scripts, educational materials, and product messaging. This role requires direct, hands-on experience with advertising and labeling issues for nutrition, dietary supplements, and CPG products. The attorney will apply FDA, FTC, DSHEA, NAD, and state consumer protection frameworks to fast-moving creative work and will partner with the General Counsel to maintain clear, compliant, and defensible brand communication.
Position Responsibilities
- Review and clear product claims, marketing copy, packaging, digital ads, landing pages, social content, videos, and email sequences for compliance with FDA, FTC, DSHEA, NAD standards, and state consumer protection laws.
● Evaluate structure/function claims, ingredient claims, substantiation requirements, and permissible health-related messaging for nutrition and dietary supplement products.
● Identify high-risk language and recommend compliant alternatives that maintain marketing effectiveness.
● Draft internal guidance on claims, substantiation, packaging requirements, disclaimers, influencer rules, and online advertising compliance.
● Support creation and maintenance of substantiation files for all product and educational claims.
● Provide risk assessments on emerging marketing strategies or scientific messaging.
● Review and clear influencer, affiliate, and UGC content for compliance with FTC Endorsement Guidelines.
● Collaborate with creative, marketing, product, R&D, and scientific teams to ensure compliant claims without slowing execution.
● Escalate complex or sensitive issues to the General Counsel.
● Assist with regulatory inquiries, enforcement matters, and process improvements for recurring content reviews.
Basic Qualifications (Required – No Exceptions)
- JD and active license to practice law in at least one US jurisdiction.
● 3+ years of experience in advertising law, consumer protection, regulatory compliance, or similar practice area.
● Hands-on experience with CPG, nutrition, and dietary supplement advertising is required.
● Deep familiarity with FDA and FTC regulations governing nutrition and supplements, including structure/function claims, labeling rules, and substantiation standards.
● Experience reviewing marketing collateral, claims, packaging, and product descriptions for regulatory compliance.
● Ability to provide fast, practical, risk-balanced guidance in a fast-moving environment.
● Strong legal writing, issue-spotting, and communication skills.
Preferred Skills
- In-house experience at a CPG, supplement, wellness, or nutrition company.
● Familiarity with NAD precedent and claim substantiation methodologies.
● Experience advising creative teams, performance marketers, and content producers.
● Experience with influencer marketing compliance and FTC Endorsement Guides.
● Experience building or improving internal content review processes.
● Background in early-stage, high-growth, or founder-led companies.
